Cancer Study -- Groundwater Plume Area
The cancer study in the area of groundwater contamination is proceeding. The NYSDOH has been reviewing the information we received from the New York State Cancer Registry on people diagnosed with cancer while living in the study area. We are continuing to gather and review information from other sources on residents diagnosed with cancer while living in the study area, people who may have developed cancer after moving away, and the plume contaminants these people
may have been exposed to.

Health Statistics Review -- Former Public Water Supply for Village
NYSDOH staff are continuing to acquire birth outcome and cancer data.

Soil Vapor Intrusion Investigation Update
The NYSDOH and NYSDEC are currently evaluating the final soil vapor intrusion sampling data. The agencies will notify the homeowners of their results once this evaluation is completed, which will be no later than May 16th.

Focused Feasibility Study for Groundwater Interim Remedial Measure
The NYSDOH reviewed and approved the revised Focused Feasibility Study for Groundwater Interim Remedial Measure document.

Cancer Study -- Groundwater Plume Area
The cancer study in the area of the groundwater contamination is continuing. The NYS DOH is reviewing the information we received from the New York State Cancer Registry on people diagnosed with cancer while living in the study area, and have begun to gather additional information.

Update 01/11/2008
The summary of DEC activities between December 21, 2007 and January 11, 2008 is now available. The DOH reported no additional updates were available since their last report.

The
Final Immediate Investigation Work Assignment Reportdated December 2007 is also available (79 pages). The appendices (lab data usability summary report, June public meeting posters and well inspection records) will be made available as soon as possible.


Update 12/21/2007
The NYS Department of Environmental Conservation report to the Town Board outlining activities for the period December 7 to 21 is available in pdf format for download.

Additional Home Vapor Testing:
Seven additional homes on the northern, western, and eastern boundaries of the groundwater plume have had their basements tested for chemical vapors by the NYSDEC. Homes on Pine Tree Drive, Red Fox Run, and Dryer Road were tested. Results of the testing will available in January. NYSDEC conducted the additional testing to further verify the boundaries of the plume.

Follow Up Ventilation System and Private Well Checks at Homes:
In regard to Private Well Testing, the NYSDEC has no plans to retest any private wells. They are confident that any private wells that tested high for chemical contamination have been converted to Public water. They also think they have the dynamics of the plume understood well enough to be confident that no other private wells that are in use are at risk of being contaminated (based on private well locations and the depths at which water is being extracted by the homeowner).

In regards to Ventilation System Testing, the NYSDEC will not conduct additional chemical testing in any of the homes that have had basement ventilation systems installed. However, they will offer to do physical system testing at any home with an installed system (that being checking the efficiency and effectiveness of system's operation by taking vacuum measurements).The NYSDEC will be sending a letter to citizens explaining this next week.

TOWN OF VICTOR SEEKS VOLUNTEERS FOR MODOCK SPRINGS ADVISORY COMMITTEE
Victor residents! Are you interested in volunteering to serve for 12 months on a committee that will provide direction to, and input on, the Modock Springs Groundwater Contamination Investigation? This committee will coordinate discussion and meetings with the Department of Health and the New York State D.E.C. and will oversee effective information sharing among State agencies, the Town and the Victor community.
 
Responsibilities:
* Attend an average of two meetings a month
* Review pertinent studies and documents
* Actively participate in the work of the committee

DEC activities related to the time period November 23 to December 7, 2007 are now available in pdf format. 

In addition to the information provided in the NYSDEC's update report on the public availability sessions (Nov. 28th and 29th) and the agencies' review of the Draft Focused Feasibility Study for Groundwater Interim Remedial Measure and draft soil vapor intrusion investigation report documents, the NYSDOH has the following updates for the Modock Road Springs -- DLS Sand & Gravel, Inc. site: Cancer Study -- Groundwater Plume Area:

The NYSDOH has received the listing of people who were diagnosed with cancer while living on the streets of the study area (see attached map) from the New York State Cancer Registry. We will be reviewing this list to check for any unusual cancer patterns (other than the previously noted unusual occurrence of brain tumors). We will also be considering what additional information we will need to obtain for the investigation.

Health Statistics Review -- Former Public Water Supply for Village NYSDOH staff are moving ahead with the health statistics review for the Village of Victor and are in the process of acquiring the birth outcome and cancer data from other NYSDOH units.

DEC report to the Town Board prior to their 11/26/2007 meeting is available in pdf format. The DOH indicated no additional information was available. The cancer study research is ongoing.


Update 11/13/2007
Public Availability Sessions will be held November 28th and 29th by the NYSDOH and the NYSDEC at the temporary Town Hall of Victor (1290 Blossom Drive). Details around the updates are attached.

Malcolm Pirnie (Contractor hired by NYSDEC) has completed two reports on their work at the Modock Springs/DLS Sand and Gravel, Inc., Site. Both are being reviewed by the NYSDEC and the NYSDOH. The draft reports are the Immediate Investigation Work Assignment Summary Report and the Focused Feasibility Study for Groundwater Interim Remedial Measures Summary Report. These reports will describe what work has been competed and identify some potential next steps in their investigation and remediation plan.

The NYSDEC and the NYSDOH is planning to start additional vapor intrusion sampling to confirm the overall boundaries that were determined in the initial vapor intrusion sampling program. This additional work will be completed during the 2007/2008 heating season.

Following a meeting of the Village of Victor and the NYSDOH, the Village of Victor Board ofTrustees past a resolution asking the NYSDOH to conduct a health statistics review due to concerns with Modock Springs dringking water. More information will be posted as it becomes available.

NYSDOH is proposing a cancer study for the streets highlighted in blue on the map illustrated on the form. The study will include all people diagnosed with any type of cancer (excluding basal & squamous cell skin cancers) since 1990. On June 26th the DEC & the DOH hosted an informational meeting at the Victor Education Center. The presentation is available for download in pdf format.

UPDATE 6/18/2007
The DEC reports borings are being installed just downgradient of the source area to assess the possibility of installing a permeable reactive wall as an interim remedial Measure (IRM).

Source area passive samplers have been placed in an effort to identify the exact location of the source of the contamination. The retrieval of the samples and analysis began last week.

Additional data from vapor intrusion sampling is undergoing data validation and continues to be addressed by the DOH.

The NYS Department of Health and NYS Department of Environmental Conservation will be hosting an informational meeting on June 26th at the Victor Education Center on the Victor Central School campus at 6:00 PM.

They will also be at the Victor Town Hall on June 26th between the hours of Noon and 4 PM and on June 27th between the hours of 9 AM - 2 PM to provide an opportunity for the public to consult with them on an individual basis regarding the Modock Remediation.

Action Plans


On Thursday, April 5th, at my request, I met in Albany with NYS Deputy Secretary for the Environment Judith Enck - Governor Spitzer's Environmental Chief, Dr. G. Anders Carlson from the NYS Department of Health - Preventive Health and Health Services and Dale A. Desnoyers, NYS Department of Environmental Conservation - Director of Division of Environmental Remediation.

My purpose, as a representative of the citizens of Victor, was to meet with the appropriate State agencies in a calm, focused setting to address the community's expectations regarding the Modock Springs Remediation. It was a very successful meeting with the State agreeing to undertake the actions listed below.

I believe it is critical now for the State agencies to continue to assertively do their work so that we can move forward with the contamination source location, identification and remediation as quickly as possible.

Our meeting accomplishments on behalf of the community are as follows:

1. Extension of the vapor testing site to thirty (30) homes beyond the recognized perimeter of the current testing area - testing to begin in April.

2. Continued expedited water and vapor intrusion testing and reporting.

3. Domestic water supply testing extended to within a one-mile radius of the pit with additional mapping, to begin in April.

4. Aggressive formal definition of the source to begin in April as follows:
1 Source identification.
2. Identification of the extent of contamination.
3. Determination of the concentration of contaminants.
4. Identification of alternatives to deal with the contamination.
5. Outcome process conducted as follows:
1. Draft Record of Decision will be issued
2. Public comment period will be held in Victor
3. Final Record of Decision will be issued

5. Strengthened efforts to identify funding sources over the next 90 days including the Superfund and grants.

6. Provisions undertaken to encourage sharing of testing history at time of property ownership transfers.

7. Public session(s) held in Victor, hosted by the appropriate NYS department - expected to begin in June 2007. These will also include test results and state experts to meet one-on-one with residents.

8. Continued accelerated lines of communication on a daily and as-needed basis indefinitely between Town officials and State agencies. Updates will be conducted the day of board meetings to allow me to provide the very latest information in my report, under "Reports of Town Officials" - Supervisor Report. Public comments will be heard under "Public Comment."

9. Re-sampling of both water and vapor intrusion to continue.

10. Aquifer maps provided by the state for posting on our website.

11. NYS DEC and Town Building Code Enforcement Officials collaboration on radon compliance with sample codes provided to be used in the preparation of Town Code.

12. Recommended signage prepared and water and vapor testing conducted at the Modock Springs site.

My sincere appreciation to all who responded and participated in Monday evening's community briefing.

Thank you to our more than 150 residents and property owners who listened and voiced their concerns with our officials from the Department of Environmental Conservation (DEC) and the Department of Health (DOH), Ontario County Public Health, the Town Board and Department Heads, our Town Attorney and Special Council and our State Representatives and media partners. In addition, we are most appreciative for the many e-mails, personal telephone calls, and resident visits.

The following actions were taken this week:
• The Town has acted and will continue to act as a conduit between our State and Federal Representatives and Agencies and our residents and property owners.

• Immediate action was taken to communicate information as it became available by creating a dedicated page on this website. It includes contact information, links to the Department of Environmental Conservation and Department of Health websites, links to specific information on those sites addressing TCE and vapor intrusion, the corrected fact sheet sent to residents identified as being in the area of investigation in January 2007, and information on how to contact your Town Officials. A DEC plume map is also available on the website and in the Town Clerk's office. (see below)

• Elected state and federal representatives have been contacted and have committed their help and resources to this project.

• A Citizens Advisory Committee is being created to facilitate resident input and involvement.

Beginning April 2nd:
• A Status Report on the Modock Springs Remediation is scheduled for the Special Meeting of the Victor Town Board to be held at the Victor Parks and Recreation Department, 1290 Blossom Drive, Monday, April 2, 2007 at 7:00 p.m. This briefing will follow the business portion of the meeting. Representatives from the state will be present. The
agenda is available on the website.

• As information becomes available, it will posted on the website and in the Town Clerk's office. FAQ's (frequently asked questions) from the DEC and DOH will also be available.

• Daily communication will continue between the Town Supervisor's office and the DEC and DOH and our federal and state representatives.

• Continued Town department meetings will be ongoing to maximize customer service.
