TOWN OF VICTOR - NOTICE OF ADOPTION OF A LOCAL LAW SUBJECT TO PERMISSIVE REFERENDUM
NOTICE IS HEREBY GIVEN that the Town Board of the Town of Victor, County of Ontario, State of New York, at a regularly scheduled meeting held on December 27, 2021, duly adopted the following Local Law subject to permissive referendum:
TOWN OF VICTOR - LOCAL LAW NO. 6 OF 2021 - OPTING OUT OF ALLOWING CANNABIS RETAIL DISPENSARY LICENSES WITHIN THE TOWN OF VICTOR AS AUTHORIZED UNDER CANNABIS LAW ARTICLE 4
BE IT ENACTED by the Town Board of the Town of Victor, County of Ontario, State of New York as follows:
Section 1. Intent.
It is the intent of the Town of Victor Town Board to opt out of allowing retail dispensary licenses within the Town of Victor (“the Town”) that would otherwise be allowed under Cannabis Law Section 131.
Section 2. Authority.
This Local Law is enacted pursuant to Cannabis Law § 131 which specifically authorizes the Town Board to adopt a local law requesting the Cannabis Control Board to prohibit the establishment of retail dispensary licenses within the jurisdiction of the Town and is subject to a permissive referendum, the procedure of which is governed by Municipal Home Rule Law § 24.
Section 3. Local Law Opting Out of Cannabis Retail Dispensary Licenses.
The Town Board of the Town of Victor hereby opts out of allowing retail dispensary licenses from being established and operated within the Town’s jurisdiction.
Section 4. Severability.
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person, firm or corporation, or circumstance, shall be modified by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law so modified or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 5. Repeal.
All ordinances, local laws and parts thereof inconsistent with this Local Law are hereby repealed.
Section 6. Permissive Referendum/Referendum on Petition.
This Local Law is subject to a referendum on petition in accordance with Cannabis Law § 131 and the procedure set out in Section 24 of the Municipal Home Rule Law.
Section 7. Effective Date.
This Local Law shall take effect immediately upon filing in the office of the New York State Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.
A PETITION, TO BE VALID, MUST BE SUBMITTED WITHIN FORTY-FIVE (45) DAYS OF THE DATE OF ADOPTION OF THIS LOCAL LAW.
