A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, May 2, 2022, at 7:00 p.m. at the Victor Town Hall, 85 East Main Street, Victor, NY to consider the following applications.
INTERPRETATION REQUEST FOR CODE SECTION application from Brad Hollowell, Victor resident, for an interpretation of code § 211-23 Commercial/Light Industrial District regulations. A Landscaping business is not specifically listed in §211-22. A. which lists permitted uses for both the Commercial District and the Commercial Light Industrial District. Code §211-23. B. (7) allows for a Special Use Permit, should the Zoning Board of Appeals determine that the use as a Landscape Business is in the same general character as the permitted uses and is in accord with the stated purpose of the Commercial/Light Industrial District. The applicant has stated that they are looking to rent out the two existing dwellings on the property. The Zoning Board will need to determine if this is in accordance with §211-23. B.(2)(b), being that the residential use will be subordinate to Landscaping Business. The proposed interpretation is in regard to 6424-6426 State Route 96 and is zoned Commercial Light Industrial and is owned by Jean Gabrielli.
