LEGAL NOTICE
A public hearing will be held before the Town of Victor Zoning Board of Appeals on Monday, May 6, 2019 at 7:00 p.m. at the Victor Town Hall, 85 East Main Street, Victor, NY, to consider the following area variance applications:
1. RAND MANAGEMENT, 7710 State Route 251, Victor, NY
Is requesting a Sprinkler Waiver for a 2,000 square foot addition at the northeast corner of the existing building. The building is required to have a sprinkler system per Section 83-4F(2)(a) of the Town of Victor Code which states that all structures shall be required to have an approved fire sprinkler system installed and operational, however, §83-4F(2)(d) states that the Zoning Board of Appeals can grant a waiver. The property is zoned Lt Industrial.
2. EASTSIDE MARTIAL ARTS, 7263 State Route 96, Victor, NY
Is requesting an area variance for a 240 inch by 32 inch wall sign, whereas, §165-5B(5) states a wall sign must be no greater in sign area than half of one square foot for each foot of linear building frontage. The applicant has only 9.5 square feet of wall frontage. Also to be considered is §165-4A(5), to determine of the different colors of the proposed sign are of a consistent theme. The property is zoned commercial light industrial and owned by Astrea, LLC
3. KETTLE RIDGE FARM, 515 Log Cabin Road, Victor, NY
Is requesting a Sprinkler Waiver for three new farm buildings being constructed on the property. The buildings will be utilized for agricultural and ag-tourism purposes. The building is required to have a sprinkler system per Section 83-4F(2)(a) of the Town of Victor Code which states that all structures shall be required to have an approved fire sprinkler system installed and operational, however, §83-4F(2)(d) states that the Zoning Board of Appeals can grant a waiver. The property is zoned Residential 2 and owned by Joe Hurley.
4. TWO INTERPRETATION REQUESTS FOR THE SAME CODE SECTION, consider the two applications from Dennis Buchovecky and Susan Davie, Victor residents, for an interpretation of Code §211-19 to determine if townhomes are allowed in R-1 zoned districts. The proposed interpretation is in regards to the Piper Meadows Subdivision on High Street.
